I have recieved many E-mails from a group called Ban the Ban Wisconsin in the past several months that reflect the ideals that many smokers in Illinois feel as well. That the smoking ban inposed on the smokers in this state and on other states as well, is not only an imposition on us but it is also a form of discrimination. In reality this discrimination is  no different than the discrimination that the Black people felt back in the 50's and 60's in places like Alabama where Rosa Parks I believe her name was (I could be misstaken about her name) finally got tired of moving to the back of the bus and stood her ground. Smokers are the Black people of the 2000's. We are told where and when we can smoke by businesses, we are told now that we arent allowed to smoke in our cars if we have children in them. Those anti-smokers are using psudo science to back up their claims about SHS ( second hand smoke). There has not been 1 shread of true scientific evidence that backs up the anti's claim about shs, but yet they push all of those legislatures and individual small town city councils that have no backbone to stand up to those anti's and just say no. Those anti's claim that we are infringing upon their rights to breathe fresh air well they are infringing upon our rights to smoke freely. They want all people to live by their standards and forcing their standards upon smokers and that ideal is so arrogant. This is still a free country, you claim that smoking infringe upon your rights to breathe smoke free air, but you mention nothing about the polution put out by cars, trucks, factories, the chemical polutants put out by the fryers at state fairs, yes folks there are chemicals in the greese mist of the food fryers at outside events, so why arent driving cars and trucks banned, or state fair food vendors banned, or factories put out of business. You anti's make me sick with your constant wining about shs this nation has a long history that includes tobacco, at 1 time in our nations history, tobacco was even a commodity used for financial transactions, yes folks if you check your history tobacco was used just like our dollar is used now. So the next time you anti's want to eliminate the rights of smokers and show the world how arrogant you are by making people live by your standards you just try to imagine where this country would be if it wasn't for tobacco. It is a part of our historical heritage its like throwing out our Constitution, tobacco needs to stay.Anti's need to go.

Hello all of you legal eagles out there, I have a purely hypethetical question I have been pondering, and please if I am able to offend anybody good, I am not known for being politically correct. Also I will try not to make any grammatical errors but if I do please forgive them.Ok now that out of the way here goes.

The house judicial committee or congress suponeas Mr. Bush to testify about his alledged crimes while in office, that members are trying to impeach him for( I think it is 36 of them ) ,Mr. bush refuses to comply with the sopenna, so the sargent at arms goes to place President bush under arrest and forceably bring him in to testify in front of Congress to answer the charges against him. At this time the secret service attempts to place the sargent at arms under arrest for arresting  president Bush.

Question who would have the legal authority, and please forgive me if my hypethetical situation is phrased incorrectly.

I have seen many reports about the shootings in Chicago inner sity areas by the Chicago police department. The police  claim that a person was shooting at them so they shot and killed that person, claiming that the police "feared for their life". I was wondering if there was ever a time, or a situation, when it would be legal or justified to return fire on a police officer, for fearing for your life. If a police officer is going to shoot me, I believe that would qualify a situation as fearing for my life, and I would do everything in my power to stop the police officer from taking my life, including returning fire on the police officer. What I was wondering is, is there ever a time where those actions (of returning fire on a police officer) would be justified.I hope the situation never arises where I would have to make that decision. But everytime I hear of a situation where the police has shot and killed somebody, I keep thinking to myself what protections do we have FROM the police officers that were hired to SERVE AND PROTECT the citizens of this nation. From what I understand most police officers carry an extra pistol of some kind strapped to their pants on their ankles so if they have to claim they were shot at by a citizen they could put the extra pistol in the hands of the victim they just killed and make it look as though the victim did have a weapon, that way the police officer could justify his or her actions of shooting and killing the victim. Could somebody please answer this question. ( Is a citizen ever legally justified in returning fire on a police officer?)Curious.

Raising taxes on tobacco products to pay for the childrens insurance programs is not the greatest idea I've ever heard.

 1. Expecting the tobacco users of this country to pay the blunt of all the expences is not only wrong, it is also discriminating to the tobacco users .If you are a non tobacco user and have sick children wouldn't you expect your self to pay for the care of your own children instead of somebody else paying for there care.

 2. Smoking tobacco products has never been scientifically proven to cause the illnesses but the Congress want to raise tobacco taxes as a so called sin tax and I might add (smoking or using tobacco products is not a sin) to pay for the illnesses, that is not only unfair but it places an additional burdon on tobacco users and it should be on the shoulders of everybody in the United States to pay for .This FET (Federal Excise Tax) is very unfair to the tobacco users in this country. Is the federal government after passing this bill going to give a subsidy to smokers and other tobacco users like they do to the tobacco growers ,probably not.It should be noted that the burden of taxes rests on the entire nation and not just 1 segment of the population that is the American way it is a descriminating practice to single out smokers to pay for the insurance needs of children only and allow the rest of the nation to get off, (scott free).I, for one do not agree with this policy and I'm sure there are others that will stand up and agree with me.this idea is just plain wrong, the burdon should fall on everybody to pay for the needs of the children and there insurance.

I saw something in the news that just blew my mind today and perhaps somebody could write about it and explain something to me.

A 17 year old black male was tried and convicted for having oral sex performed on him by a 14 year old female at a party along with several other underaged couples.I believe he was charged with statuary rape even though the14 yr old female was performing this act volintarily and willingly. Now  this young man is 21 yrs old and is still in prison appealing his case. From what I understood the young man won his appeal then the district attorney looked at the old laws concerning this type of act and is trying to keep him in prison for the Laws were written before 1970 and the new laws have been implemented to try and keep him in prison.I guess what I really don't understand is. If having Oral sex with a with a minor is illigal Than why wasn't the 14 year old girl arrested for doing an illigal act of having oral sex as a minor. Why doesn't the female minors having sex oral or otherwise being arrested and being put in prison just like the boys.It seems to me that if the Judges were to keep up with the times and change the laws that protect these innocent girls, there would be a lot less girls engageing in illigal acts of sex.If a 14 year old girl would take a shotgun and kill her parents for no other reason other than because she could, wouldn't she be tried as an adult and put in prison or at least a girls home until she reaches the age of 18 and then sent to prison. If a 14 year old girl can induldge herself in an adult activity such as sex, than she should face the consequences of her actions just like the boys should. These girls are willing partners of the boys they are performing these sexual acts on, they are not being raped.as the law proclaims .I think these laws need to be brought up to date to match the times we are living in nowadays.

With the onset of modern technology i.e.(computers,television,satalites ect....) I think I have a solution to a lot of problems we have in this country.

In my opinion, we could totally eliminate government or parts of government especially Congress, as a whole. If anything needs to be voted on we could put the law or whatever it is up to be voted upon by the people. They could be assigned a voters code number that only registered voters could obtain. They could put the proposed item to be voted on up on the internet ,on television, radio, and allow the entire country 1 week to place there vote on the issue.( Because lets face it on some issues congress takes months or even years if at all,to vote on issues except when it concerns there pay raises.)Anyway the issue would be written in layman's terms so that the average person in America could understand the issue. And have the opportunity to vote on it.Right now there are thousands of laws on the books that most americans dont even know exhist and thats a travisty. How can the justice system say (ignorance of the law is no excuse. and i know we have all heard that statement) when most americans dont even know about the laws.

If the american public was allowed to vote on propopsed laws at least everybody would know what is being voted on and why.

I  welcome any comments on this issue

That way the people would have a say as to what goes on in this country what laws are being passed what money is being spent and where it is being spent what taxes needed to be raised and why

The Rights of the american parent has been stripped from them by the System .

The system has many names in Illinois it is called DCFS.

other states call them Child Protective Services .

The system has the right to come into a parent's home anytime they want and legally kidnap your children from you without your authority or concent by getting a judge to sign a court order without a thread of evidence against you.

And even after the investigation is unfounded and nothing has been done wrong by the parent's , the parent's find it allmost impossible to have there children returned immediately.

DCFS claims they are protecting the children from abusive parent's but who  do the parents and the children have to protect them from DCFS.

How many children has been misplaced in the last 10 years  by DCFS   LAST COUNT(283) by placing them in foster care all throughout the united states where ever there is a place for the children  and then just forgetting about them and losing the paperwork on the children.

I think it is time the parents groop together and fight this agency tooth and nail to stop this tragedy from becoming even more of an epidimic than it has allready  become.

And if the children are abused at the foster home they are placed with, than DCFS should be held totally accountable, and responsible for placing the children there in harms way to begin with.

In my opinion DCFS should be stamped out like a cockroach infestation and never be allowed to operate under any name they wish to call themselves.

Parents should have the right to love  and disipline there children the way the parents see fit  to the exclusion of abuse.

A simple spanking has never harmed a child,as well as telling a child NO,

works very well .

DCFS says a bruise is abuse . but ill bet if I asked a pediatrition how many bruises a child will recieve naturally from the age of 18 months till the child is 10 years old the doctor will tell you thousands  and all of those bruises will be self inflicted it is a part of a childs life.

A child might be playing on monkey bars at a local playground and bumps his head on the bars ,and bruises his or her self is this the parents fault,  no.

But  DCFS in there infinite wisdom would claim child abuse and kidnap a parents child over a simple bruise.

This is just plain wrong and this action needs to be stopped.

If anybody agrees with me or disagrees with me than please respond i would like to read your comments on this issue.
